私隱與政策

在收集、維護和使用潛在的及現有的客戶的個人資料時，美建集團<美建>將會時刻遵守香港特別行政區個人資料（私隱）條例。

除非另有規定，<美建>不會收集能確認瀏覽其網站的訪客的任何個人資訊。當閣下瀏覽本網站時，<美建>會記錄閣下的來訪情況。<美建>可使用此資訊用以統計<美建>門戶網站的使用情況或出於促銷目的而使用該資訊。

如果閣下是<美建>的客戶且正在使用我們的在線服務，或者如果閣下是<美建>網站的訪客且正在申請我們的在線服務，<美建>可收集閣下的資訊。未向<美建>提供上述資訊可能導致<美建>無法進行閣下對其服務或産品的申請。此外，如果閣下通過網絡向<美建>提供上述資訊，閣下將承擔網站上列出的相關風險。

<美建>持有的個人資料將保密保管，但就閣下同意提交的個人資料可用於以下用途：

1. 在<美建>或與<美建>相關的公司、代理人或服務提供者之間互相分用、反複查證及轉移該資料；
2. 關於或有關遵守任何法律、法規、法院指令、或任何監管機構的命令或指令有關的任何用途，包括向上述任何監管機構提供其要求的資料（就該要求的權限，<美建>毋須事前就該等要求之合法性取得法津意見）；
3. 關於或有關<美建>的業務或往來事務或任何相關公司的業務或往來事務有關的任何其他用途。

<美建>將保密地保管其持有的與客戶相關的資料，但<美建>可出於前一段列出的用途，向<美建>的關聯公司、<美建>的代理人或服務提供者、監管機構、律師、審計師、信用諮詢機構或債務托收代理人，或對<美建>負有保密義務且已承擔保密該資訊的任何其它人提供該資訊，不管他們是在香港特別行政區的境內還是境外。

<美建>只許可授權的員工獲悉自閣下處收集的資訊，以確保上述資訊不會出於未授權目的而被使用或故意被修改或刪除。

<美建>保證，保護閣下的個人資料，使其免受於未授權使用或故意使用、處理或刪除，將採取恰當的物理措施、電子措施和管理措施保護閣下的個人資料。<美建>將採取所有可行的措施，確保個人資料保存時間不會超過所需的時間。按照慣例，保留的最長時間為7年。

閣下有權要求獲悉或糾正<美建>持有的關於閣下的資訊。如果閣下希望獲取或糾正閣下的個人資料，請寫信至美建集團(香港中環德輔道中300號華傑商業中心2樓)。依據個人資料（私隱）條例的條款，<美建>有權就要求使用的任何資訊要求的處理收取合理費用。

本條款不限制客戶在個人資料（私隱）條例項下的權利。

Privacy and Policy

Upbest Group Limited <UPBEST>. <UPBEST> shall at all times fully observe the Personal Data (Privacy) Ordinance of Hong Kong in collecting, maintaining and using personal data of potential and existing clients.

<UPBEST> will not collect any personal information that identifies a visitor to this site unless specified otherwise. When you visit this site, <UPBEST> will mark the record of your visit. This information will be used by <UPBEST> for keeping statistics about the usage of <UPBEST>’s web-portal or promotional purposes.

If you are <UPBEST>’s customer and are using our services on-line, or if you are a visitor and are applying for our services on-line, <UPBEST> may collect information from you. Failure to provide such information to <UPBEST> may result in <UPBEST> being unable to entertain your application for such services or products. Further, in case you provide such information to <UPBEST> over the Internet, you shall bear the associated risk which is set out hereunder.

Personal data held by <UPBEST> will be kept confidential but in submitting personal data you agree that any such data may be used for the following purposes:

1. sharing, cross-checking and transferring that data within <UPBEST> or with its related companies, agents or service providers;
2. any purpose relating to or in connection with compliance with any law, regulation, court order or order or direction of a regulatory authority including the provision of any such data to any such regulatory authority which shall request the same (without <UPBEST> having to obtain prior legal advice as to the competence of such a request);
3. any other purposes relating to or in connection with <UPBEST>’s business or dealings or the business or dealings of any related companies.

Data held by <UPBEST> relating to a customer will be kept confidential but <UPBEST> may provide such information to <UPBEST>’s related companies, <UPBEST>’s agents or service providers, regulators, lawyers, auditors, credit reference agencies or debt collection agencies, or any other person under a duty of confidentiality to <UPBEST> which has undertaken to keep such information confidential, whether they are within or outside the Hong Kong Special Administrative Region, for the purposes set out in the previous paragraph.

<UPBEST> only allows authorized employees to have access to information collected from you to ensure that such information will not be used for unauthorized purpose, or be altered or erased accidentally.

<UPBEST> will ensure that your personal data will be protected against unauthorized or accidental access, processing or erasures by implementing appropriate physical, electronic and managerial measures to safeguard and secure your personal data.

All practical steps will be taken by <UPBEST> to ensure that personal data will not be kept longer than necessary. As a general rule the maximum retention period is 7 years.

You have the rights to request access to and correction of information about you held by <UPBEST>. If you wish to access or correct your personal data, please write to the Compliance Department at Upbest Group Limited (2/F, Wah Kit Commercial Centre, 300 Des Voeux Road Central, Hong Kong). In accordance with the terms of the Personal Data (Privacy) Ordinance, <UPBEST> has the rights to charge a reasonable fee for the processing of any data access request.

Nothing in this Terms and Conditions shall limit the rights of customers under the Personal Data (Privacy) Ordinance.
